Terms and Conditions for CK Laserworks

Welcome to CK Laserworks! These Terms and Conditions ("Terms") govern your use of our website, https://www.cklaserworks.com/ (the "Site"), and the services we provide, including but not limited to custom 3D printing, laser engraving and cutting, 3D printer rentals, and design services (collectively, the "Services").
By accessing our Site or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or Services.
1. Services
CK Laserworks provides on-demand manufacturing solutions. With a substantial capacity of over 250 3D printers and a dozen laser systems, we offer:
3D Printing Services: Production of parts from digital files you provide.
Laser Cutting & Engraving: Custom cutting and engraving on various materials.
3D Printer Rentals: Rental of 3D printing equipment under a separate rental agreement.
Custom Design Services: Assistance with creating or modifying digital designs for manufacturing.
2. Quotes, Orders, and Payment
Quotes: To receive a quote for our services, you may be required to submit a digital file (e.g., CAD model). Quotes are estimates based on the information and files you provide and are valid for a period of 30 days unless otherwise stated.
Orders: Placing an order constitutes an offer to purchase our Services. All orders are subject to acceptance by us. We reserve the right to refuse any order at our sole discretion.
Payment: Full payment is required before production begins unless otherwise agreed upon in writing. We accept [List your payment methods, e.g., Credit Card, PayPal, etc.]. You agree to provide current and accurate payment information for all purchases.
3. User-Submitted Content and Intellectual Property
Your Content: You are solely responsible for the digital files, designs, and specifications you submit to us ("Your Content"). You represent and warrant that you have all necessary rights, licenses, and permissions to submit Your Content and that it does not infringe on the intellectual property rights, privacy rights, or any other rights of any third party.
License to Us: By submitting Your Content, you grant CK Laserworks a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display Your Content for the sole purpose of fulfilling your order.
Prohibited Content: You agree not to submit any content that is unlawful, offensive, threatening, defamatory, or that violates any party's intellectual property. We reserve the right to reject any project that contains prohibited content.
Our Content: All content on our Site, including text, graphics, logos, and software, is the property of CK Laserworks or its suppliers and is protected by copyright and other intellectual property laws.
4. Shipping and Delivery
Turnaround Times: Estimated production and delivery times are provided in your quote. These are estimates and not guarantees. We will make every reasonable effort to meet these estimates but are not liable for delays.
Shipping: Shipping costs will be included in your quote. Risk of loss and title for all products pass to you upon our delivery to the carrier. You are responsible for any customs fees, duties, or taxes associated with your order.
5. Returns, Refunds, and Quality Guarantee
We stand by the quality of our work.
Defects: If you believe your product is defective or does not conform to the specifications of your order, you must notify us in writing at info@cklaserworks.com within 14 days of receipt. Please include photographic evidence of the issue.
Our Obligation: At our discretion, we will either replace the defective product or issue a credit/refund. Our liability is limited to the cost of the product you ordered. We are not responsible for any issues arising from design flaws in Your Content.
Returns: Due to the custom nature of our Services, we do not accept returns for non-defective products.
6. 3D Printer Rentals
All 3D printer rentals are governed by a separate Rental Agreement, which you must agree to before the rental period begins. The Rental Agreement will outline terms regarding security deposits, proper usage, liability for damages, and return procedures.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CK LASERWORKS, ITS OFFICERS, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SITE OR SERVICES, OR THE PERFORMANCE OF THE PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THE USE OF OUR SERVICES IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICE IN QUESTION.
8. Indemnification
You agree to indemnify, defend, and hold harmless CK Laserworks and its affiliates from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your infringement of any third-party rights, including intellectual property rights, related to Your Content.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Any legal action or proceeding related to this Site shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Henry County, Georgia.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will post the revised Terms on the Site and update the "Last Updated" date. Your continued use of the Site or Services after any such changes constitutes your acceptance of the new Terms.
